1. AGREEMENT TO TERMS 

1.1. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Pilates Obsession Pty Ltd ("Pilates Obsession", "Company", "we", "us", or "our") regarding your access to and use of the Pilates Obsession mobile application, website, and related services (collectively, the "Service"). 

1.2. By accessing or using the Service, you agree that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service. 

2. ELIGIBILITY 

2.1. You must be at least 16 years of age to access or use the Service. If you are under 18 years of age, you must have parental or guardian consent to use the Service. 

2.2. By using the Service, you represent and warrant that you have the legal capacity to enter into these Terms and comply with their provisions. 

3. ACCOUNT REGISTRATION AND SECURITY 

3.1. To use the Service, you must create an account by providing accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. 

3.2. You agree to promptly notify us of any unauthorized use of your account or any breach of security. 

4. SUBSCRIPTION TERMS AND FEES 

4.1. The Service is offered via subscription plans, which may include monthly and 6-month subscription options. 

4.2. New users may be eligible for a 14-day free trial period. 

4.3. Subscriptions automatically renew at the end of each subscription period unless cancelled by the User prior to renewal. 

4.4. You may cancel your subscription at any time through your account settings or the relevant third party platform (e.g., Apple App Store, Google Play Store). 

4.5. Payments are processed through Stripe, Apple App Store, Google Play Store, or other authorized third-party payment processors. 

4.6. We reserve the right to amend subscription fees upon no less than 30 days' notice, which will be communicated to you via the Service or by email. 

5. REFUNDS 

5.1. Except where required by law, all fees and payments are non-refundable.  

5.2. Refund requests for subscriptions purchased through third-party platforms must be directed to the respective platform in accordance with their refund policies. 

6. HEALTH DISCLAIMER 

6.1. The Service provides general fitness, wellness, and educational content. The information is not medical advice and is not a substitute for professional medical diagnosis, advice, or treatment. 

6.2. You acknowledge and agree that you are solely responsible for your use of the Service and any risks involved. You should consult a qualified healthcare provider before starting any new fitness program. 

7. USER CONDUCT 

7.1. You agree that you will not: (a) Use the Service for any unlawful purpose; (b) Share your account credentials or allow others to access your account; (c) Interfere with or disrupt the Service or its security features; (d) Upload, post, or transmit any unlawful, offensive, defamatory, or harmful content. 

7.2. We reserve the right to suspend, restrict, or terminate your access to the Service if you breach these Terms. 

8. INTELLECTUAL PROPERTY 

8.1. All intellectual property rights in the Service, including but not limited to content, logos, videos, text, designs, trademarks, and software, are owned by or licensed to Pilates Obsession Pty Ltd. 

8.2. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial use only. You must not reproduce, modify, distribute, or exploit any part of the Service without our express written consent. 

9. SALES OF PRODUCTS 

9.1. Physical products may be offered for sale through the Service. Purchases of products are subject to separate terms and conditions presented at the time of sale, including pricing, shipping, returns, and warranty provisions. 

10. PRIVACY 

10.1. Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. 

11. LIMITATION OF LIABILITY 

11.1. To the maximum extent permitted by law, Pilates Obsession Pty Ltd and its directors, officers, employees, contractors, or agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or relating to your use of the Service. 

11.2. Nothing in these Terms excludes any liability that cannot be excluded under applicable law. 

12. INDEMNITY 

12.1. You agree to indemnify, defend, and hold harmless Pilates Obsession Pty Ltd, its affiliates, officers, directors, employees, agents, and licensors from and against all claims, liabilities, losses, expenses, damages, and costs (including reasonable legal fees) arising out of your breach of these Terms or misuse of the Service. 

13. GOVERNING LAW AND JURISDICTION 

13.1. These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria, Australia. 

14. MODIFICATIONS TO TERMS 

14.1. We may update or amend these Terms at any time at our discretion. Continued use of the Service after changes are made constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
